These terms apply to every quotation, order and agreement with Cervano for the design, production and installation of bespoke interiors, unless otherwise agreed in writing. Departures apply only after written confirmation.
Quotations are without obligation and valid for 30 days unless stated otherwise. An agreement is formed after written confirmation by both parties. Bespoke work is made on the basis of the agreed dimensions, materials and finishes as recorded in the design file.
We work as standard with the specifications set out on our website under Specifications, including shelves made to measure in the thickness the piece calls for, an 18 mm back panel in the finish of the cabinet, Blum hinges and drawers and seamless edge bonding. Because every project is bespoke, the final dimensions, materials, finishes and hardware choices are always discussed with you and recorded in the order form. What is stated there is what applies.
Prices are in euros, including VAT for private customers unless stated otherwise. Payment is made in instalments as set out in the order form: a first payment on confirmation to reserve production, and the balance on completion or delivery.
If, as a consumer, you do not pay on time, we first send a free reminder. Only after the period stated in it has expired do statutory default interest and a fixed compensation become due, within the limits the law imposes for consumers. If we ourselves are in default, you are entitled to equivalent compensation.
The customer is responsible for the accuracy of dimensions and plans provided, unless Cervano has measured on site. Changes to a design in progress are made in writing and may affect the price and the lead time.
If, as a consumer, you conclude an agreement at a distance or away from our business premises, you have in principle 14 days to change your mind. Under the law that right does not apply to goods manufactured to your specifications or clearly intended for you personally.
Cervano supplies bespoke work only. Every piece is drawn and made to your dimensions, in the materials and finishes you choose, and is therefore not reusable for anybody else. The whole order thus falls under that statutory exception, and there is no right of withdrawal for the bespoke work once the order form is signed. We point this out to you expressly before signing, and the order form states it again.
For services that precede it, such as measuring, design and guidance, you keep the 14-day cooling-off period. If you expressly ask us to start those services within that period, you pay on withdrawal for the part already delivered at that moment.
The delivery period is always agreed with you and recorded in the order form. If exceptionally nothing has been agreed, the statutory period of 30 days after the order applies. If we exceed the agreed period, you may give us a reasonable additional period in writing. If we still fail to deliver, you may dissolve the agreement and reclaim the amounts paid. Delay caused by force majeure or by a cause on the customer side, such as an inaccessible site or a room that is not ready, suspends the period.
Cervano delivers and installs in Belgium. Deliveries outside Belgium take place only after express written agreement, whereby the transport and installation conditions are determined per project. The customer provides smooth access to the site and a suitable, dry space.
Visible defects are reported on completion and recorded in writing. Defects that were not visible at that moment can still be invoked afterwards within the statutory warranty period. Small differences in colour or grain in natural materials such as timber, stone and leather are inherent to the material and do not constitute a defect.
As a consumer you enjoy the statutory warranty of two years against lack of conformity, counting from delivery. That warranty does not affect your other statutory rights. Normal wear, incorrect use and damage caused by the customer fall outside it. If we additionally agree a commercial warranty, its duration is stated in the order form.
Cervano's liability is limited to the amount of the assignment concerned. Cervano is not liable for indirect damage. This limitation does not apply in the event of intent or gross fault by Cervano or its appointees, does not apply to personal injury, and does not apply where the law prohibits the limitation.
If you have a complaint about the performance, report it as soon as possible by email to hello@cervano.be or by telephone on +32 496 71 87 22. We confirm receipt and reply within 14 days. If we cannot resolve it together, you may as a consumer turn free of charge to the Consumer Mediation Service, Koning Albert II-laan 8 box 1, 1000 Brussels, consumentenombudsdienst.be.
Belgian law applies to every agreement. For disputes with a consumer, the courts designated by law have jurisdiction. For disputes with a business, the courts of the Antwerp district have jurisdiction.
These terms exist in Dutch, English and French. In the event of a discrepancy between the language versions, the Dutch text prevails.
